Cancellation Policy
You agree to try out Level Up Glen Cove for personal training WAIVER/RELEASE of LIABILITY/INDEMNIFICATION FORM This Waiver/Release of Liability/Indemnification is given in consideration of NRH Consulting of NY Inc dba LEVEL UP Glen Cove (The Company) a company organized and existing in accordance with the laws of New York, Nicole Robinson-Helmus (trainer), and all persons or instructors accepting my fee based on participation in classes involving physical activity and use of exercise equipment and facilities (hereinafter the Activity) provided by the Company. I acknowledge the Activity requires that I engage in physical activity and exercises that will at times be strenuous and involve risk of serious injury, including permanent disability and death. I am advised to check with my physician before participating in the Activity so that I am aware of my physician’s concerns and/or cautions regarding limitations, if any, on my participation in the Activity. I agree to be solely responsible for my safety and wellbeing. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY AND ALL RISKS OF LOSS OR DAMAGE (BOTH ECONOMIC AND NON-ECONOMIC) TO MY PROPERTY, OR PERSONAL INJURY, INCLUDING DISABILITY AND DEATH, THAT I MAY SUSTAIN AS A RESULT OF OR ARISING OUT OF MY PARTICIPATION IN THE ACTIVITY. FURTHER, I HEREBY FULLY AND FOREVER RELEASE AND DISCHARGE THE COMPANY, ITS INSURERS, MEMBERS, PARTNERS, EMPLOYEES, OFFICERS, DIRECTORS, AND ASSOCIATES, LESSORS, AND EQUIPMENT AND FACILITY OWNERS (the “COMPANY INDEMNITIES”) FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, RIGHTS OF ACTION, OR CAUSES OF ACTION, PRESENT OR FUTURE, WHETHER THE SAME BE KNOWN OR UNKNOWN, ANTICIPATED, OR UNANTICIPATED, RESULTING FROM OR ARISING OUT OF MY PARTICIPATION IN THE ACTIVITY. I EXPRESSLY AGREE TO INDEMNIFY AND HOLD THE COMPANY AND THE COMPANY INDEMNITIES (defined above) HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, DAMAGES, RIGHTS OF ACTION, OR CAUSES OF ACTION, OF ANY PERSON OR ENTITY THAT MAY ARISE FROM INJURIES OR DAMAGES SUSTAINED BY ME. Except by a written notice (to include electronic communication) to the Company, this Waiver/Release of Liability/Indemnification cannot be cancelled, voided, or otherwise made null. Any such notice will be immediately effective upon its receipt by the Company (the “Effective Cancellation Date”) but only as of, and from, the Effective Cancellation Date.
